In Race Case, Will Justice Kennedy Go from Liberal Hero to Goat?

Supreme Court Justice Anthony Kennedy has been lionized as a liberal hero since his sweeping opinion authorizing same-sex marriage last summer. But Wednesday, the court will hear arguments in a case in which he may crush the hopes of his liberal fans.

Kennedy is expected to be the court’s swing vote deciding whether race-based affirmative action will survive on college campuses. And on this issue, he’s been decidedly more skeptical.

The case, Fisher v. University of Texas, could impact admissions policies at nearly every college and university, and it’s coming before the court at a moment when campuses are awash in racial protests.
